I have been approached by a defendant in a patent infringement case. In the course of the litigation, a forensic examination was conducted, which acknowledged his use of a patented design. I analyzed the decision and formed a review in which I showed that the trial examiner's arguments were inconsistent. The court accepted the arguments of the review and dismissed the plaintiff's claims without ordering a new examination.
